Club PENSHOPPE is a loyalty program owned and operated by Golden ABC, Inc., a multi-awarded fashion enterprise with brands: PENSHOPPE, OXGN, FORME, MEMO, REGATTA and BOCU. This program is designed to reward customer loyalty with various benefits such as discounts, exclusive promotions and other rewards. The term “Service” encompasses both the Platform and the services detailed therein. “Users” refers to individuals who have registered an account and use the Platform (referred to collectively and individually as “User,” “You,” or “Your”).

8.5 In accordance with Golden ABC, Inc.'s Terms and Conditions, any User (including employees, agents, representatives, or any person acting on behalf of or for the User) who possesses Data obtained through our Services (referred to as "Data Receivers") agrees to the following:
a. Comply with all applicable Personal Data Protection laws regarding the Data, including the collection, processing, storage, or transfer of such Data.
b. Permit Golden ABC, Inc. or other Users, who are the owners of Personal Data collected by the Data Receivers (referred to as "Disclosers"), to delete their Personal Data from the Data Receivers' database.
c. Allow Golden ABC, Inc. or the Disclosers to inspect the Data collected by the Data Receivers in accordance with (a) or (b) to ensure compliance with and fulfillment of obligations under applicable law.
8.6 Notwithstanding the provisions outlined in this Policy, Service Providers or merchants (including officers, employees, agents, representatives, or any person acting on their behalf) must adhere to all applicable Personal Data Protection laws. For any Personal Data obtained from Golden ABC, Inc., the following conditions apply:
a. The use of User's Personal Data is strictly prohibited unless it is reasonably required to respond to User inquiries, enforce, process, or complete any transactions, and must be done with prior written notice to the Users and Golden ABC, Inc.
b. Service Providers and merchants may not contact Users using their Personal Data outside the Platform.
c. The disclosure of User's Personal Data to third parties is not permitted without prior written consent from both the Users and Golden ABC, Inc.
d. Adequate security protocols must be implemented to protect Users' Personal Data in their possession. This Data should only be retained for as long as necessary for the intended purposes and in accordance with the applicable Personal Data Protection Act. Upon request or after the completion of the transaction, the Data must be either deleted or returned to Golden ABC, Inc.
e. Any suspected breaches or loss of User's Personal Data must be reported immediately to Golden ABC, Inc.'s Personal Data Protection Officer at dpo@goldenabc.com.
9. Information Collected by Third Parties
We, along with third parties, may offer Services that require you to download application software to enable your use of the Service. These applications may operate independently and may allow third parties access to identifiable information, such as your name, User ID, and IP address, and any cookies previously installed by you or by the third-party application or platform. The Products or Services of third parties provided through the Application are not affiliated with Golden ABC, Inc. nor are they controlled by Golden ABC, Inc. We recommend that you review the terms and conditions published by the aforementioned third parties on such Platforms or elsewhere.
Your Personal Data may be transferred, stored, or processed outside the Philippines, primarily in Singapore, with backup servers located in Hong Kong (the People’s Republic of China). Golden ABC, Inc. will ensure that any overseas transfer of your data complies with applicable laws and privacy regulations, and will be conducted only as permitted and authorized by law.
11. Rights as a Personal Data Owner

13.1 Objectives - We use Closed-circuit Television (CCTV) in and around the company premises to monitor specific areas, ensuring the security and safety of property, assets, employees, customers, and visitors. The purposes of this surveillance are:
13.1.1 To protect your personal health and safety, including your belongings.
13.1.2 To safeguard our building, facilities, and assets from damage, interference, vandalism, and other criminal activities.
13.1.3 To support law enforcement organizations in preventing, protecting against, investigating, and conducting legal proceedings.
13.1.4 To assist in dispute resolution during disciplinary or grievance proceedings.
13.1.5 To aid in the interrogation process or filing of complaints.

To achieve our stated purposes, the company has installed Closed-circuit Television (CCTV) in visible locations, clearly marked with warning signs at entrances and exits, both outside and inside the building, physical stores, and other areas deemed appropriate for monitoring. When you enter these areas, we may collect the following types of Personal Data:

- Sound
- Images of your property (e.g., vehicles, bags, hats, and garments)
However, the company will not install CCTV in areas that might inappropriately infringe on your basic rights, such as restrooms, shower rooms, fitting rooms, or employee relaxation areas.

We will safeguard Personal Data using corporate and technical measures that meet or exceed legal requirements. This includes implementing appropriate systems to protect and secure the data within a restricted access framework.
13.6 Disclosure of Personal Data to The Third Parties
13.6.1 We may disclose your Personal Data to third parties, including our affiliates and service providers, when necessary to achieve the purposes outlined.
13.6.2 We may also disclose your Personal Data to law enforcement organizations to fulfill our legal obligations and assist in preventing, investigating, and conducting criminal proceedings.
13.6.3 Additionally, we may allow the CCTV vendor to access the data for specific system maintenance, provided they have our authorization and maintain a personal data protection system.
13.7 Retention Period of Personal Data
To fulfill the monitoring purposes outlined in this announcement, Golden ABC, Inc. will retain your Personal Data captured by CCTV for a maximum of forty-five (45) days from your entry into our buildings, stores, or premises. After this period, the CCTV footage will be automatically deleted.
